Terms of service
The basics
These terms are the agreement between you and Murder Apparel when you use murderapparel.com, buy from us, or sign up for our emails or texts. By using the site or placing an order, you agree to these terms, our Privacy Policy, Refund Policy and Shipping Policy.
Please read the Disputes section. It says most disagreements will be handled by individual arbitration instead of in court or as a class action, and it explains how to opt out.
You must be at least 16 to use the site, and at least 18 (or have a parent's permission) to place an order.
Effective date: October 4th 2026. We may update these terms. If we do, we'll change the date above, and the version posted when you place an order is the one that applies to that order.
Orders, prices and payment
- Placing an order: Your order is an offer to buy. It's accepted when we ship it. We may cancel or limit any order, for example for a pricing error, suspected fraud, or resellers buying in bulk. If we cancel, we'll refund you in full.
- Prices: Prices are in US dollars and can change at any time. Taxes and shipping are added at checkout. If we list something at the wrong price by mistake, we'll contact you before shipping and you can cancel for a full refund.
- Payment: Payments are processed through Shopify's checkout. You confirm that you're allowed to use the payment method you give us.
- International orders: You're responsible for any customs duties, import taxes or fees your country charges, unless they're collected at checkout.
- Discounts and promotions: Codes can't be combined unless we say so, have no cash value, and may expire. We can end a promotion at any time, but we'll honor it for orders already placed.
- Cancelling: Email us right away. We can cancel if your order hasn't gone into production yet. Once it's printing, it's covered by our Refund Policy instead.
Shipping, returns and defects
- Shipping: Shipping times are estimates. See our Shipping Policy. If we can't ship within the time we promised, we'll let you know and you can cancel for a full refund. Once a package is handed to the carrier, the risk of loss passes to you, but if a package is lost in transit, contact us and we'll help sort it out.
- Wrong address: Double-check your address. We aren't responsible for orders sent to an address you gave us that turns out to be wrong, but we'll try to help.
- Returns and exchanges: See our Refund Policy.
- Defects or wrong items: If something arrives damaged, misprinted or wrong, email a photo and your order number within 30 days and we'll replace it at no cost.
- Your legal rights still apply. Customers in the EU, UK and some other places have legal rights, such as the right to cancel an online order within 14 days. Nothing in these terms takes those rights away.
Our products
- Made to order: Most items are printed or embroidered after you order them, which is why they take a few days to make.
- Colors and placement: Screens show colors differently, and printing varies a little from piece to piece. Small differences in color, print size or placement aren't defects.
- Sizing: Use the size chart on each product page. Some items run small, and we note that on the page.
- Care: Follow the care instructions to keep prints looking good. Wear and tear from normal use or washing that doesn't follow the instructions isn't a defect.
- What the designs mean: Many of our designs are satire, parody, dark humor or political speech. They're meant as jokes and opinions, not literal statements, threats or endorsements of violence.
Accounts, rewards and gift cards
- Your account: Keep your login private. You're responsible for activity on your account. We may suspend accounts used for fraud or abuse.
- Rewards points: Points have no cash value, can't be sold or transferred, and can only be used as described in the rewards program. We may change or end the program with reasonable notice. Points you've already earned will stay redeemable for at least [FILL IN: e.g. 30 days] after any change.
- VIP club: VIP designs and access are a perk, not something you've paid for separately. Please don't share the VIP password. We may change VIP benefits at any time.
- Gift cards: Gift cards don't expire, can't be redeemed for cash except where the law requires it, and can't be replaced if lost or stolen.
Reviews, ideas and using the site
- Reviews: Reviews must be honest and about your own experience. We don't edit reviews to change their meaning, and we post negative reviews too. We may remove reviews that are spam, off-topic, hateful, or that share someone's private information. If we ever give a perk for leaving a review, we'll say so next to the review.
- Photos and content you send us: When you submit a review, photo or other content, you let us show it on our site and social media, with credit to you. You keep ownership of it. You confirm you have the right to share it and that anyone shown in it is okay with that.
- Design ideas: We love hearing ideas, but we may already be working on something similar. Sending us an idea doesn't create any obligation to use it, pay for it, or credit you, unless we agree in writing.
- Don't: use bots or scrapers on the site, try to hack or overload it, resell our products as official merchandise of another brand, or use the site for anything illegal.
Our designs and intellectual property
- Our stuff: The designs, artwork, photos, text and the Murder Apparel name and logo belong to us or the artists we work with. Buying a product lets you wear and use it, not copy or resell the design. Please don't reproduce our designs without permission.
- Parody and commentary: Some designs comment on or poke fun at public figures, pop culture or other brands. Unless a product says otherwise, we're not affiliated with or endorsed by anyone referenced in a design.
- If you think we've used your work: We take this seriously. Email aaron@murderapparel.com with the subject line "IP Notice" and include: your contact information; the work or trademark you own; a link to the product you're concerned about; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and you're the owner or authorized to act for the owner, with your signature. We'll review it and respond promptly, and we'll remove the product while we look into it when appropriate.
Text message terms
- Program: Murder Apparel sends recurring marketing texts (new drops, sales, cart reminders) and order updates to people who opt in.
- Consent: By signing up, you agree to receive recurring automated marketing texts from Murder Apparel at the number you give us. Consent isn't a condition of any purchase.
- Frequency and cost: Message frequency varies. Message and data rates may apply.
- Opting out: Reply STOP to 844-931-0173 at any time to unsubscribe. You'll get one confirmation text, then no more marketing texts.
- Help: Reply HELP or email aaron@murderapparel.com.
- Carriers: Carriers aren't liable for delayed or undelivered messages.
- Privacy: See our Privacy Policy. We don't share your mobile number or text opt-in consent with third parties for their marketing.
Disclaimers and limits
Disclaimer: Except for the promises we make in these terms and our policies, the site and products are provided "as is." To the extent the law allows, we disclaim all other warranties, including implied warranties of merchantability and fitness for a particular purpose. This doesn't limit any warranty or right that the law says can't be limited.
Limit of liability: To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages. Our total liability for any claim about an order is limited to what you paid for that order. Our total liability for any other claim is limited to $100.
Indemnity: If you break these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs from that claim.
These limits don't apply to anything the law doesn't let us limit, such as liability for death or personal injury caused by negligence, or fraud. Some places don't allow certain limits, so some of this may not apply to you.
Disputes
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT.
- Talk to us first. Most problems can be fixed by email. Before starting any formal claim, send a written notice to aaron@murderapparel.com describing the problem and what you want. Both sides agree to try in good faith to resolve it for 60 days.
- Individual arbitration. If we can't resolve it, any dispute about these terms, the site, our products or our marketing (including texts and emails) will be decided by binding individual arbitration, not in court. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. It can be held by video or phone, or in your home county. The arbitrator can award you the same individual relief a court could. Fees are paid as the AAA Consumer Rules require, which limits what you pay.
- Exceptions. Either of us can bring an individual claim in small-claims court instead. Either of us can also go to court to stop infringement of intellectual property.
- No class actions. You and we each agree to bring claims only on an individual basis, not as a plaintiff or class member in any class, collective or representative action. The arbitrator can't combine claims of different people. You and we waive any right to a jury trial.
- Mass filings. If 25 or more similar arbitration demands are filed by the same lawyers or coordinated groups, they'll be handled in batches of up to 10, with the rest put on hold while each batch is decided. This keeps the process fair and manageable for everyone.
- Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these terms by emailing aaron@murderapparel.com with the subject "Arbitration Opt-Out" and your name and email. Opting out doesn't affect anything else in these terms.
- If part of this is struck down. If the class-action waiver is found unenforceable for a claim, that claim goes to court, not to class arbitration, and the rest of this section still applies.
- Governing law and venue. These terms are governed by the Federal Arbitration Act and the laws of New York, without regard to conflict-of-law rules. Any case that's allowed to go to court will be heard in the state or federal courts in New York County, New York.
- Where you live matters. If you live somewhere, like the EU or UK, whose consumer laws don't allow parts of this section, those parts don't apply to you, and you keep your right to bring claims in your local courts.
Everything else
- Things outside our control: We aren't responsible for delays caused by events we can't reasonably control, such as carrier problems, supplier shortages, natural disasters or outages.
- Links: Links to other sites (like the charities we support) are for your convenience. We aren't responsible for their content.
- Ending access: We may suspend or end your access to the site if you break these terms. Sections that by their nature should survive, like Disputes and the limits of liability, still apply afterward.
- Whole agreement: These terms and the policies they mention are the full agreement between us. If any part is found unenforceable, the rest still applies. If we don't enforce something right away, we haven't given up the right to enforce it later. You can't transfer your rights under these terms, but we can transfer ours if the business is sold.
